Terms of Service

1. Acceptance of Terms

By accessing or using the Medispot platform at trymedispot.com ("Platform"), operated by Rome MD Consulting PC ("Medispot," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. You must be at least 18 years of age to use this Platform. By creating an account, you represent that you are 18 or older and legally capable of entering into binding agreements.

2. Nature of the Platform; No Medical Services

Medispot is an online marketplace that connects patients with independent, licensed medical aesthetic providers ("Providers"). MEDISPOT IS NOT A HEALTHCARE PROVIDER AND DOES NOT PROVIDE MEDICAL SERVICES, MEDICAL ADVICE, OR CLINICAL CARE OF ANY KIND. Medispot does not practice medicine, does not employ licensed medical professionals in a clinical capacity, and does not direct or supervise the medical judgments of any Provider. All medical and clinical decisions — including determinations of patient candidacy for any treatment — are made solely by the licensed Provider at the time of your appointment. Use of the Platform does not create a doctor-patient relationship between you and Medispot.

3. Provider Vetting and Verified Status

Medispot reviews Provider credentials, licensure, and facility documentation prior to approving them for listing on the Platform ("Medispot Verified"). This verification process is intended to confirm that Providers hold appropriate professional licenses at the time of approval. However, Medispot does not continuously monitor Providers after approval, does not supervise clinical care, and does not guarantee the quality, safety, or outcome of any treatment. The "Medispot Verified" designation indicates only that a Provider passed our one-time credentialing review and nothing more. Medispot is not responsible for the acts, errors, omissions, or negligence of any Provider.

4. Medical Candidacy and Refunds

All aesthetic treatments carry inherent medical risks. By booking through the Platform, you acknowledge that the Provider retains full clinical discretion to determine whether you are an appropriate candidate for any treatment. If a Provider determines, for documented medical reasons, that you are not a candidate for a booked treatment, your booking will be cancelled and you will receive a full refund of all amounts charged, including any cancellation hold. In such cases, Medispot will review the Provider's stated medical reason before processing the refund. This review process exists to protect patients and to ensure that medical cancellations are made in good faith. Refunds for medical non-candidacy will be processed within 5–10 business days.

5. Booking, Payment, and Cancellation

All bookings are subject to the 7-day rolling availability window. Payment is collected in full at the time of booking confirmation. Your card is charged immediately when a booking is confirmed.

Cancellation policy: Cancellations made more than 24 hours before the scheduled appointment will receive a full refund to the original payment method. Cancellations made within 24 hours of the scheduled appointment will result in a $50 cancellation fee being retained by Medispot; the remaining balance will be refunded to the original payment method.

No-show policy: If you do not attend your scheduled appointment and have not cancelled in advance, a $100 no-show fee will be retained by Medispot and the remainder will be refunded to your original payment method. Medispot reserves the right to modify the cancellation and no-show policy with reasonable notice.

6. Rewards Points

Medispot Points are earned at a rate of 10 points per $1 spent on completed treatments. Points vest only after a treatment is marked as completed by the Provider. Cancelled or refunded bookings do not earn points. Points redeemed at checkout will be returned to your balance if the booking is subsequently cancelled or refunded. Points have no cash value outside of the Platform, are non-transferable, and may not be sold or exchanged. Medispot reserves the right to modify, suspend, or terminate the rewards program at any time with reasonable notice. Accrued points have no monetary value upon account termination.

7. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify Medispot immediately of any unauthorized use of your account. Medispot is not liable for any loss resulting from unauthorized use of your account. You may not create accounts on behalf of others or use the Platform for any unlawful purpose.

8. Provider Obligations

Providers represent and warrant that they hold all required professional licenses, permits, and malpractice insurance required by applicable state law. Providers agree not to use the Platform to solicit patients for services outside the Platform or to circumvent Medispot's booking and commission system. Providers who cancel bookings in bad faith — including by falsely claiming patient non-candidacy to avoid Platform commissions — may be suspended or permanently removed from the Platform at Medispot's sole discretion.

9. Prohibited Conduct

Users may not:

  • use the Platform for any unlawful purpose;
  • attempt to circumvent the booking or payment system;
  • contact Providers directly to book services outside the Platform after discovering their identity through a Medispot booking;
  • submit false information;
  • harass other users;
  • reverse engineer or scrape the Platform; or
  • use the Platform in any way that could harm Medispot or other users.

10. Intellectual Property

All content on the Platform, including but not limited to the Medispot name, logo, design, text, and software, is the property of Rome MD Consulting PC and is protected by applicable intellectual property laws. You may not use, reproduce, or distribute any Platform content without express written permission.

11. Disclaimers

The Platform is provided "as is" and "as available" without warranty of any kind, express or implied. Medispot does not warrant that the Platform will be uninterrupted, error-free, or free of viruses. Medispot does not endorse, warrant, or guarantee the quality, safety, legality, or outcomes of any treatment provided by any Provider. Results of aesthetic treatments vary by individual and are not guaranteed.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Medispot and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, or damages arising from personal injury, bodily harm, or dissatisfaction with treatment outcomes, whether based on warranty, contract, tort, or any other legal theory, even if Medispot has been advised of the possibility of such damages. Medispot's aggregate liability to any user shall not exceed the total amounts paid by that user through the Platform in the twelve months prior to the claim.

13. Indemnification

You agree to defend, indemnify, and hold harmless Medispot and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in connection with your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

14. Dispute Resolution and Arbitration

Any dispute arising out of or relating to these Terms or your use of the Platform shall be resolved by binding arbitration in Los Angeles, California, under the rules of the American Arbitration Association, rather than in court, except that either party may bring claims in small claims court. YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTION LAWSUITS. These Terms are governed by the laws of the State of California without regard to conflict of law principles.

15. Modifications

Medispot reserves the right to modify these Terms at any time. We will notify users of material changes by email or prominent notice on the Platform. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

16. SMS Program Terms

Medispot operates an SMS messaging program that sends transactional and optional promotional messages to patients who provide their mobile phone number.

Transactional messages include: booking confirmations, appointment reminders sent 48 hours, 24 hours, and 2 hours before each appointment, and cancellation notifications. Transactional SMS consent is required at account signup if a phone number is provided and cannot be revoked while you have an active account with a phone number on file, because these messages are necessary to the provision of the service under TCPA's transactional exemption.

Promotional messages include: welcome nudges for new patients who have not yet booked a treatment, rebook reminders following completed treatments, and occasional service offers. Promotional SMS consent is optional and must be expressly opted into via a separate checkbox at account signup. Promotional SMS consent can be revoked at any time.

Message frequency varies by account activity, but is capped at a maximum of three promotional messages per seven-day rolling period per phone number. Transactional messages are sent only in response to booking activity.

Message and data rates may apply. Your mobile carrier may charge for messages sent or received depending on your plan.

Reply HELP for help. Reply STOP, STOPALL, UNSUBSCRIBE, END, QUIT, or CANCEL to unsubscribe from promotional messages. Transactional messages will continue to be sent after opting out of promotional messages because they are required for booking services.

Phone ownership is verified via one-time password at account signup before any SMS is sent. Updating your phone number on file requires re-verification and re-consent.

17. Email Marketing

Medispot sends transactional and optional promotional emails to patients who provide their email address.

Transactional emails include: booking confirmations, appointment reminders, cancellation notifications, and account-related notices. These emails are necessary to the provision of the service and are sent to all account holders regardless of marketing preferences.

Promotional emails include: welcome messages, rebook reminders, and occasional service offers. Promotional email consent is optional and must be expressly opted into at account signup. Promotional emails can be unsubscribed from at any time by clicking the unsubscribe link in any promotional email.

Email marketing is operated through a third-party email service provider. Your email address and consent state are shared with this provider solely for the purpose of sending Medispot emails. No personal health information or treatment details beyond general service category are shared.
